Abstract
The spread of Generative Artificial Intelligence (GAI) in higher education has done more than change the tools used to teach and learn: it has reshaped the pedagogical relationship itself and has produced a kind of dispute that barely existed before, what we call here the technological-identity conflict arising from academic fraud. This article grounds the Theory of Mediating Action in the Face of Technological-Identity Conflicts as an epistemological and methodological paradigm in its own right, set against the two responses that prove inadequate today: the formal penal-disciplinary system and the traditional models of mediation. It concludes that Mediating Action—protected in Spain by Law 3/2022 on university coexistence—offers a restorative matrix able to shift the punitive reflex toward a dialogic space centred on the student's metacognition, symbolic reparation, and the long-term care of the educational bond.
