Abstract
El régimen de custodia compartida cada vez está siendo más conocido y se está empleando en muchos de los divorcios o separaciones que se están dando hoy día, existiendo una circular de la Fiscalía General del Estado que aconseja imponerla. Por ello, el principal objetivo que se pretende alcanzar con la realización del presente estudio, es conocer las consecuencias que puede llegar a sufrir un menor, el cuál sus progenitores han tomado la decisión de separarse o divorciarse, tomando para ello el régimen de custodia compartida. Se desea conocer dichas consecuencias tanto en el ámbito familiar como escolar, por ello, al comienzo del trabajo se han planteado una serie de hipótesis las cuáles, tras realizar la investigación pertinente, se podrán corroborar o no. Para obtener la información requerida, se ha empleado como instrumento la técnica de la entrevista, fijando una población muestra concreta. La muestra seleccionada se encuentra dividida en tres bloques, diferenciándose entre: profesores de secundaria y primaria, madres que se encuentran separadas o divorciadas con dicho régimen y otros profesionales relacionados con la materia; educadores y trabajadores sociales y abogados especialistas en esta materia.
The shared custody regime is becoming more and more known and is being used in many of the divorces or separations that are taking place today, and there is a circular of the Attorney General's Office that advises to impose it. Therefore, the main objective to be achieved with the realization of this research project is to know the consequences that can be suffered by a minor, which their parents have decided to separate or divorce, taking for it the shared custody regime. It is desired to know these consequences both in the family and school environment, therefore, at the beginning of the project a series of hypotheses have been raised which, after carrying out the relevant research work, can be corroborated or not. In order to obtain the required information, a semi-structured interview was used as an instrument, establishing a specific sample population. The selected sample is divided into three blocks, differentiating between: secondary and primary school teachers, mothers who are separated or divorced under this regime and other professionals related to the subject, educators and social workers and lawyers specializing in this area.
