Abstract
La violencia sexual en el seno de la pareja o expareja sentimental supone un claro atentado contra la libertad sexual del sujeto pasivo, que nada desmerece por el mero hecho de ejecutarse en el marco actual (o pasado) de tal relación. En este sentido, el legislador ha procedido a penar de forma más gravosa estos atentados sexuales, si bien, dicha agravación se ha hecho extensible también a los supuestos de violencia sexual ejecutada por la pareja o expareja de los menores de dieciséis años. Si bien la pertinencia de calificar los atentados sexuales contra estos sujetos como un delito contra la libertad sexual no queda en entredicho, lo cierto es que la actual configuración del art. 181.5 d) CP plantea más dudas que soluciones. A estos efectos se propone un análisis del marco legal en que propició la reforma que introdujo el precepto a la par que un estudio de su fundamento y consecuencias en aras de vislumbrar la viabilidad práctica de penar de forma autónoma estos supuestos típicos en el tenor del art. 181 CP.
Sexual violence amid an intimate relationship is a blatant breach of the sexual freedom of the victim, which is in no way diminished by the mere fact that it is committed in such context. In this regard, the legislator proceeded to punish these sexual offences more severely, although this aggravating circumstance has also been extended to those cases of sexual violence carried out by the partner or ex-partner of a person under sixteen. Although the relevance of classifying sexual assaults against these subjects as an offence against sexual freedom is not in question, the fact is that the current configuration of art. 181.5 d) CP raises more doubts than it solves. To this end, we propose an analysis of the legal framework that led to the reform that introduced the provision, as well as a study of its foundations and consequences to glimpse the feasibility of punishing these cases within art. 181 of the Spanish Criminal Code.
