Sharenting: nuevo reto para el derecho a la imagen y a la protección de datos de la infancia y la adolescencia

Abstract

El sharenting o el afán de los progenitores por compartir imágenes de sus hijos está sobreexponiendo a los menores a las redes sociales y los está convirtiendo en “influencers colaterales”. Esta conducta puede constituir una intromisión ilegítima al derecho fundamental a la intimidad, al honor y a la propia imagen del menor, así como afectar al derecho fundamental a la protección de datos. En este artículo se va analizar desde un punto de vista normativo y jurisprudencial: (i) en qué casos nos encontramos ante una violación de estos derechos fundamentales y en qué casos no se contempla tal intromisión; (ii) el valor del consentimiento del menor y la edad y madurez para prestarlo según la normativa internacional y nacional; (iii) las formas en las que se puede proteger los derechos fundamentales del menor y el papel del Ministerio Fiscal.

Sharenting or eagerness of parents to share images of their children is overexposing minors to social networks and turning them into "collateral influencers". This conduct may constitute an unlawful interference against the fundamental right to privacy, honor and the child's own image, as well as affect the fundamental right to data protection. This article will analyze from a normative and jurisprudential point of view: (i) in which cases we are faced with a violation of these fundamental rights and in which cases such intrusion is not contemplated; (ii) the value of the minor's consent and the age and maturity to give it according to international and national regulations; (iii) the ways in which the fundamental rights of the minor can be protected and the role of the Public Prosecutor's Office.
