Abstract
La Ley Orgánica 10/2022, de 6 de septiembre, de garantía integral de la libertad sexual, ha incorporado al Código penal español un nuevo tipo delictivo destinado a luchar contra el acoso callejero. La nueva figura se incorpora en el artículo 173. 4 CP y lo define como una forma de injurias o vejaciones injustas de carácter leve. En este trabajo se examina la experiencia internacional en esta materia y se indaga sobre los instrumentos que ya antes de la reforma disponía la legislación para responder a esta problemática. En definitiva, se trata de analizar la necesidad de la incorporación a la legislación penal española de un delito específico destinado a recoger las formas más extremas de este fenómeno social y de valorar los primeros resultados.
Organic Law 10/2022, of September 6, on the comprehensive guarantee of sexual freedom, has incorporated a new type of crime into the Spanish Penal Code aimed at fighting street harassment. The new figure is incorporated into article 173.4 CP and defines it as a form of slight insults or unfair humiliation. This work examines the international experience in this matter and investigates the instruments that the legislation already had before the reform to respond to this problem. In short, it is about analyzing the need to incorporate into Spanish criminal legislation a specific crime aimed at collecting the most extreme forms of this social phenomenon and assessing the first results.
