Abstract
El marco normativo regulador vigente en materia de tutela de las incapacidades laborales frente al despido ¿objetivo¿ por ineptitud o discapacidad no es sólo insuficiente, sino también en muchos aspectos decididamente inadecuado, para garantizar el principio de igualdad y no discriminación. Sería necesario llevar a cabo una reforma legal finalista de orientación social del grupo normativo de referencia que garantice eficazmente la tutela frente al despido de trabajadores afectos de incapacidad o discapacidad para el trabajo a través de actuaciones ilegítimas (o más contundentemente discriminatorias) de los empleadores.
The regulatory framework in force in the area of guardianship of labour disabilities against "target" dismissal for inadequacy or disability is not only insufficient, but also in many respects decidedly inadequate, to ensure the Principle of equality and non-discrimination. It would be necessary to carry out a final legal reform of social guidance of the normative group of reference that effectively guarantees the guardianship against the dismissal of workers affected of inability or disability for work through illegitimate (or more forcefully discriminatory) actions by employers
