AB El marco normativo regulador vigente en materia de tutela de las incapacidades laborales frente al despido ¿objetivo¿ por ineptitud o discapacidad no es sólo insuficiente, sino también en muchos aspectos decididamente inadecuado, para garantizar el principio de igualdad y no discriminación. Sería necesario llevar a cabo una reforma legal finalista de orientación social del grupo normativo de referencia que garantice eficazmente la tutela frente al despido de trabajadores afectos de incapacidad o discapacidad para el trabajo a través de actuaciones ilegítimas (o más contundentemente discriminatorias) de los empleadores.
