Nuevos modelos familiares: maternidad subrogada y Trabajo Social.

Abstract

Nuestro ensayo pretende, en el marco de los nuevos modelos familiares, abordar en profundidad, y desde la perspectiva del Trabajo Social, una temática especialmente controvertida en estos momentos en nuestro país: la maternidad subrogada. Consideramos que esta cuestión es especialmente relevante para nuestra profesión. Se ha abierto el debate social sobre la posibilidad de permitir que este proceso se lleve a cabo íntegramente en España, con la oportunidad de hacer padres a personas que tienen muy limitada esa posibilidad, pero con los riesgos que pudiera conllevar esto para las madres gestantes y, por otra parte, hay que plantearse atender los derechos y necesidades específicas de los niños, y de las familias españolas en las que se integran, que fueron concebidos gracias a una madre gestante residente en el extranjero bajo la cobertura legal del país de ésta.

A este fin, realizaremos una aproximación conceptual al fenómeno de maternidad subrogada, analizaremos los aspectos legales en España y el panorama internacional al respecto, señalaremos los puntos más significativos del debate ético-jurídico-ideológico, situación tanto de las familias que quieren acceder a este tipo de maternidad como aquellas que ya lo han hecho y el papel del Trabajo Social ante esta nueva realidad social. Es por ello, que el abordaje de este fenómeno se presenta bastante complejo y más cuando, a pesar de ser una realidad que está emergiendo existe aún una gran invisibilidad social entorno a la maternidad subrogada.

Our essay pretends, in the framework of the new family models, to approach in depth from the perspective of Social Work, an especially controversial theme at the moment in our country, as it is surrogacy. We consider this question to be especially relevant to our profession. The social debate has been opened on the possibility of allowing this process to be carried out entirely in Spain, with the opportunity that people who have very limited the possibility of being parents can it be, but with the risks that this could lead for the pregnant mothers and, on the other hand, it is necessary to consider the specific rights and necessities of the children and the Spanish families in which they are integrated, for which they were conceived thanks to a pregnant mother residing abroad under the legal coverage of her country.

With this purpose, we will carry out a conceptual approach to the concept of surrogacy, we will analyze the legal aspects in Spain and the international scenario in this regard, we will point out the most significant points of the ethical-legal-ideological debate, the situation of the families who want to access this type of maternity and those that have already done it and the role of Social Work face with this new social reality. It is for this reason that the approach of this phenomenon it is presented as quite complex and even more when, in spite of being a reality that is emerging, there is still a great social invisibility around surrogate motherhood.
