Abstract
La reforma del artículo 84 del Estatuto de los Trabajadores llevada a cabo por el Real Decreto-ley 2/2024, de 21 de mayo, ha intensificado los complejos problemas de inseguridad jurídica existentes para determinar con corrección el convenio colectivo aplicable. El presente estudio analiza críticamente dichos problemas, aportando posibles vías de solución tanto en situaciones de concurrencia no conflictiva como en situaciones de concurrencia conflictiva, y ofrece respuestas a las dudas interpretativas suscitadas por la nueva prioridad aplicativa de los convenios y acuerdos de Comunidad Autónoma.
The reform of Article 84 of the Workers' Statute, introduced by Royal Decree-Law 2/2024 of May 21, has exacerbated the complex legal uncertainties surrounding the accurate determination of the applicable collective agreement. This study critically examines these issues and offers potential solutions for both non-conflictual and conflictual concurrency situations. Additionally, it addresses the interpretive uncertainties raised by the new priority application of regional community collective agreements and accords.
