La autodeterminación de género en el ámbito educativo: mecanismos de implementación en las universidades

Abstract

El derecho de autodeterminación de género tiene importantes implicaciones en el desarrollo del derecho a la educación y muy concretamente en el ámbito universitario. El estudio analiza, en primer lugar, las dificultades que afronta el reconocimiento del derecho de autodeterminación de género y el impulso que la legislación autonómica ha supuesto para superar el inicial enfoque antidiscriminatorio, en favor de un concepto jurídico-constitucional de identidad desarrollada con plena libertad. Después se analiza cuál es la posición de las Universidades y qué mecanismos tienen para garantizar la tutela integral de la identidad de género, con especial atención a las Universidades de la Comunitat Valenciana.The right to gender self-determination has important implications in the development of the right to education and very specifically in the university sphere. The study analyzes, in the first place, the difficulties faced by the recognition of the right to gender self-determination and the impulse that the regional legislation has supposed to overcome the initial anti-discrimination approach, in favor of a legal-constitutional concept of identity developed with full freedom. Afterwards, the position of the Universities is analyzed and what mechanisms they have to guarantee the integral protection of gender identity, with special attention to the Universities of the Comunitat Valenciana.
