Seguridad e higiene en el trabajo durante el primer franquismo: estructuras jurídicas e institucionales

Abstract

El artículo realiza un análisis histórico-jurídico de las principales normas e instituciones que en materia de prevención de riesgos laborales fueron implantadas por el primer franquismo, acotado a estos efectos entre los años 1938 y 1956. Partiendo del análisis histórico de las normas más relevantes del periodo, el artículo pretende evidenciar el modelo de organización de las relaciones productivas configurado por el primer franquismo. Con esta finalidad, se presta una especial atención a la conformación del deber de protección del empresario que diseña el sistema franquista, considerándolo un principio esencial de las relaciones laborales que, trascendiendo lo estrictamente preventivo, penetra en el terreno de lo moral. --------------------------------------------------------------------------------The article carries out a legal-historical analysis of the main rules and institutions, which regarding labour risk prevention, were introduced by the first Francoism, thus being limited between 1938 and 1956. Based on the historical analysis of the most relevant standards of the period, the article aims to highlight the model of organization of the productive relations set up by the first Francoism. To this end, special attention is paid to the establishment of the duty to protect the employer who designed the Francoist system, it being considered a fundamental principle of labour relations which, going beyond what is strictly preventive, enters the world of the moral.
