Europa social: cuestiones para un futuro debate

Abstract

El presente trabajo tiene por objeto abordar determinadas cuestiones que, a juicio de la autora, deberían ser tratadas en un futuro debate sobre la Europa social. Para ello, se presentará, como punto de partida, la situación actual del denominado Modelo social europeo a partir de un recorrido por la configuración de las diferentes técnicas de creación del derecho social europeo: armonización de las legislaciones, diálogo social, método abierto de coordinación y ¿constitucionalización¿ de los derechos sociales. Una segunda parte del trabajo se dedicará a plantear ciertos temas concretos que deberían ser objeto de tratamiento en el futuro, entre ellos, los siguientes: la reformulación del art. 153 TFUE, el establecimiento de un marco jurídico facultativo sobre negociación colectiva transnacional, la modificación de las directivas sobre información, consulta y participación interna de los representantes de los trabajadores en las empresas, el potencial del método abierto de coordinación, y la adhesión de la Unión Europea tanto al Convenio Europeo de Derechos Humanos, como a la Carta Social Europea revisada.

The objective of this paper is to present relevant themes thatshould be addressed in a future debate concerning Social Europe. As a starting point, the paper will analyzethe actual situation of the European Social model. This task will be doneconsideringtheways through which European labor law is beingconstructed: harmonization of social regulations, social dialogue, open method of coordination and ¿constitucionalization¿ of fundamental labor rights. Then, in a second part of this paper, the author will present thequestions that should be considered in the case of a future debate on Social Europe, which includedthe following: the reformulation of art. 153 TFUE, the establishment of a non-binding legal framework regarding collective bargaining at transnational level, the modification of Directives on workers information, consultation and internal participation rights, the potential of the open method of coordination and, finally,UE accession to the European Convention on Human Rights and to the revised European Social Charter.
