La experiencia del SIMA en los procedimientos relacionados con la legitimación y representatividad en la negociación colectiva (2012-2021)

Abstract

En un modelo de negociación colectiva de eficacia general como el español quien negocia de entre los posibles interesados en la negociación, en que ámbito y el porcentaje de representatividad que ostentan organizaciones empresariales y sindicales son aspectos de vital importancia para los negociadores.

El trabajo aborda las dificultades de los negociadores de convenios colectivos y de otras instituciones en la constitución de las mesas de negociación y durante la gobernanza del convenio colectivo, a través del análisis de los 283 procedimientos relacionados con la legitimación y representatividad que se tramitaron en el SIMA en la última década. El trabajo analiza también las causas de la discrepancia, tanto legales como extralegales, y el contenido de los acuerdos de mediación y laudos arbitrales dictados

In a generally effective collective bargaining model such as the Spanish one, who negotiates from among the possible stakeholders in the negotiation, in what area and the percentage of representation held by business and union organizations are aspects of vital importance for negotiators.

The work addresses the difficulties of the negotiators of collective agreements and other institutions in the constitution of the negotiation tables and during the governance of the agreement, through the analysis of the 283 procedures related to the legitimacy and representativeness that were processed in the SIMA in the last decade. The paper also analyzes the causes of the discrepancy, both legal and extralegal, and the content of the mediation agreements and arbitration awards issued.
