Abstract
El trabajo estudia la importancia del informe pericial psiquiátrico a la hora de evaluar la discapacidad del sujeto pasivo, con un enfoque desde la práctica de los tribunales sobre posibles incidencias en la proposición y realización de esta prueba, la diferencia entre la valoración médica y la valoración judicial, criterios del juez para poder apartarse del resultado probatorio alcanzado por el perito y exigencia de una motivación reforzada para garantizar el derecho a la la tutela judicial efectiva. Y, finalmente, el control casacional en caso de error judicial en la valoración de la prueba.
This paper examines the importance of psychiatric expert reports in assessing the disability of the defendant, adopting an approach grounded in judicial practice with regard to potential issues arising in the proposal and conduct of such evidence. It analyses the distinction between medical assessment and judicial assessment, the criteria enabling the judge to depart from the expert’s evidentiary conclusions, and the requirement of enhanced reasoning in order to guarantee the right to effective judicial protection. Finally, it addresses cassation review in cases of judicial error in the assessment of evidence
