Crónica de la jurisprudencia del Comité Europeo de Derechos Sociales - 2020

Abstract

La presente crónica aborda un año crucial (2020) en el que la actividad del Comité Europeo de Derechos Sociales se ha enfrentado a la grave crisis provocada por la pandemia de la Covid-19. En este sentido, la jurisprudencia del Comité sobre el sistema de informes se ha centrado en un grupo temático particularmente afectado por dicha crisis (¿Empleo, formación e igualdad de oportunidades¿). Por otro lado, la jurisprudencia del Comité sobre el procedimiento de reclamaciones colectivas se ha visto especialmente reforzada, con ocasión de la resolución de quince importantes reclamaciones, por los nuevos perfiles en materia de lucha contra la brecha salarial de género y la representación de las mujeres en los puestos decisorios en el seno de las empresas privadas. Por último, este trabajo pone el énfasis, al menos, en tres lecciones que debemos aprender a la luz de la crisis del coronavirus: a) El Comité Europeo de Derechos Sociales ha ofrecido nuevos elementos en su jurisprudencia (Observación interpretativa sobre el derecho a la salud en tiempos de pandemia) que hacen más visible la Carta Social como el instrumento más significativo de protección de los derechos sociales en Europa, incluso en tiempos de crisis. b) La crisis (sanitaria, social, económica¿) no puede ser un pretexto para reducir la protección de los derechos sociales sino, al contrario, incluso para asumir más compromisos (aceptación por parte de España de la Carta Social revisada y del mecanismo de reclamaciones colectivas). c) La crisis debe conducir a una dinamización del ¿Proceso de Turín¿ consolidando la Carta Social como ¿Constitución Social de Europa¿.

This review tackles a crucial year (2020) in which the activity of the European Committee of Social Rights has faced a serious crisis caused by the Covid-19 pandemic. Indeed, the Committee¿s case-law on the reporting system has focused on a thematic group particularly affected by such crisis (¿Employment, training and equal opportunities¿). On the other hand, the Committee¿s case-law on the collective complaints procedure has been especially reinforced as result of the resolution of fifteen important complaints, addressing new profiles in both the fight against the gender pay gap and the participation of women in decision-making positions within private companies. Finally, this essay emphasizes, at least, three lessons to be learned in light of the coronavirus crisis: a) The European Committee of Social Rights has offered new elements in its case-law (State of interpretation on the right to health in times of pandemic) that make the Social Charter more visible as the most significant instrument for the protection of social rights in Europe, even in times of crisis. b) The (sanitary, social, economic ...) crisis cannot be a pretext to reduce the protection of social rights but, on the contrary, rather a pretext to assume more commitments (acceptance by Spain of the revised Social Charter and the collective complaints mechanism). c) The crisis should lead to a revitalization of the ¿Turin Process¿ by consolidating the Social Charter as the ¿Social Constitution for Europe¿.
