La vinculación del Registro Civil a la jurisprudencia 43/2015 de la SCJN que reconoce el matrimonio homosexual: mecanismo para la protección de la familia

Abstract

La protección de la familia es patente en la jurisprudencia 43/2015 de la Suprema Corte de Justicia de la Nación (SCJN), prevé que ninguna norma jurídica debe vincular el matrimonio a la procreación, ni limitar su celebración únicamente entre un hombre y una mujer. El Registro Civil (RC), como autoridad administrativa que interviene en la celebración del matrimonio, desatiende el citado criterio y niega las nupcias homosexuales, alegando no estar vinculado a su observancia, generando una litis ante el Poder Judicial de la Federación que busca la protección de los Derechos Humanos (DDHH) involucrados, destacando el principio de legalidad y las prerrogativas consagradas en el párrafo tercero y quinto del artículo 1° de la Constitución Política de los Estados Unidos Mexicanos (CPEUM).-----------------------------------------------------------------------The protection of the family is clear for the jurisprudence 43/2015 of the Supreme Court of Justice of the Nation , it prevents that no law must entail the marriage to procreate, nor limit its celebration only between a man and a woman. The Civil Registration, as an administrative authority that interferes in the celebration of a marriage, does not attend the quoted criterion and denies the homosexual marriages, alleging not being linked to its obedience, generating a Litis before the Federal Judicial Power that looks for the protection of Human Rights involved, highlighting the legal rule and the privileges consagrated on the third and fifth paragraphs in the 1st article in the Political Constitution of the United States of Mexico.
