El desarrollo del derecho a un ambiente sano en la perspectiva constitucional española e italiana

Abstract

Desde los años setenta se ha vuelto cada vez más urgente dar una respuesta en términos jurídicos a una circunstancia social de carácter mundial: el derecho al ambiente. En este trabajo se tratará de analizar como este tema se ha desarrollado en dos Países distintos, Italia y España, teniendo en cuenta de las declaraciones, los eventos y las normativas internacionales que han intervenido en este asunto. El interés hacia estos dos ordenamientos deriva de la distinta y ejemplar forma de reconocer este derecho en sus propias Constituciones, no sólo con respeto al derecho sino a la relativa competencia repartida entre el Estado y los entes menores. -------------------------------------------------------------------------------Since the seventies has become increasingly urgent to respond in legal terms to asocial circumstance with global nature: the right to the environment. This paperwill attempt to analyze how this issue has been developed in two differentcountries, Italy and Spain, taking into account the international statements , events and legislation that have intervened in this matter. The interest in these two systems derived from the different exemplary way to recognize this right in their Constitutions, not only with respect to the right but to the relative competition divided between the State and smaller institutions.
