La cuestión a dilucidar era si las relaciones sexuales mantenidas por ese grupo (consistentes en masturbaciones y felaciones a los tres acusados y relaciones sexuales completas con uno de ellos), fueron consentidas por la menor o, por el contrario, fueron conseguidas mediante el empleo de violencia o intimidación y, por tanto, constitutivas de agresiones sexuales. Interrogante al que se le sumaba como cuestión de suma trascendencia el que el sujeto pasivo fuera una menor de dieciséis años.
