AB El autor reflexiona sobre la situación agonizante en la que se encuentran inmersosen nuestros días algunos derechos, especialmente los sociales y los relativos a laprotección internacional. Dicha situación todavía es más preocupante si se tienenen cuenta recientes prácticas deshonestas vividas en el seno de las instanciasinternacionales más emblemáticas que se ocupan de la garantía de tales derechos(incluido el Comité Europeo de Derechos Sociales). Ahora bien, los peligros defragilización, e incluso de aniquilación, afectan al conjunto de derechos, pues losderechos forman parte de un todo. En efecto, todos los derechos (también los civilesy políticos) se ven sometidos a una especie de principio de contagio a causa de corrientes pensamiento hostiles al Estado de Derecho como exigencia axiológica deorden internacional. En última instancia, dicho contagio tiene una proyecciónnegativa en el ámbito de la acción legislativa, gubernamental y judicial bajo laapariencia y el pretexto de la lucha contra la delincuencia y otros riesgos globales,afectando a personas en situaciones de vulnerabilidad (infancia, solicitantes deasilo, etc.).
AB The author reflects on the agonizing situation in which some rights are currentlyimmersed, especially social rights and those relating to international protection.This situation is all the more worrying in the light of recent dishonest practiceswithin the most emblematic international bodies responsible for guaranteeing theserights (including the European Committee of Social Rights). However, the dangersof weakening, or even annihilation, affect all rights, because rights are part of awhole. Indeed, all rights (including civil and political rights) are subject to a kindof contagion principle due to currents of thought hostile to the rule of law as anaxiological requirement of the international order. Ultimately, this contagion has anegative projection in the field of legislative, governmental and judicial actionunder the guise and pretext of the fight against crime and other global risks,affecting people in situations of vulnerability (children, asylum seekers, etc.).
