AB Este estudio aborda la crisis climática desde una perspectiva integral, comenzando por su contextualización y la urgencia de actuar frente a sus impactos globales. Se profundiza en el concepto de equidad intergeneracional, explicando su importancia y preocupación por garantizar un futuro justo para las próximas generaciones. Se analizan los fundamentos de este principio, destacando los instrumentos internacionales, el constitucionalismo ambiental, las legislaciones nacionales y el desarrollo jurisprudencial, que buscan proteger los derechos de las futuras generaciones frente a los desafíos del cambio climático. Además, se exploran las tendencias actuales en los litigios climáticos, evidenciando cómo la justicia está siendo utilizada como herramienta para impulsar acciones concretas contra la crisis ambiental. Finalmente, el estudio presenta unas breves conclusiones que resaltan la necesidad de fortalecer estos enfoques jurídicos para lograr un equilibrio entre el presente y el futuro, promoviendo una mayor responsabilidad y justicia intergeneracional en la lucha contra el cambio climático.
AB This studyaddresses the climate crisis from a comprehensive perspective, beginning with its contextualization and the urgency to act in response to its global impacts. It delves into the concept of intergenerational equity, explaining its importance and concern forensuring a just future for upcoming generations. The fundamentals of this principle are analyzed, highlighting international instruments, environmental constitutionalism, national legislation, and jurisprudential developments aimed at protecting the rights of future generations in the face of climate change challenges. Additionally, current trends in climate litigation are explored, demonstrating how justice is being used as a tool to promote concrete actions against the environmental crisis. Finally, the studypresents brief conclusions emphasizing the need to strengthen these legal and social approaches to achieve a balance between the present and the future, fostering greater responsibility and intergenerational justice in the fight against climate change.
