AB En el presente artículo se analiza la situación jurídica y penitenciaria de los jóvenes adultos (entre 18 y 21 años, excepcionalmente hasta los 25) en las prisiones españolas. A través de un enfoque multidisciplinar y documental, se examinan los fundamentos supranacionales e históricos que inspiraron la normativa penitenciaria española, la Ley Orgánica General Penitenciaria (LOGP) y su Reglamento (RP 1996). Se destaca el principio de separación por edad y la necesidad de un tratamiento individualizado, reforzado con programas educativos, laborales y de intervención psicosocial. A partir de datos estadísticos y estudios cualitativos, se evidencia la representación minoritaria, pero vulnerable, de este colectivo en prisión, marcado por factores de exclusión social, fracaso educativo, pobreza y desestructuración familiar. La investigación, por tanto, propone reforzar el carácter educativo del sistema penitenciario juvenil-adulto, centrado en la reeducación, la prevención de la reincidencia y la rehabilitación.
AB This article analyzes the legal and penitentiary situation of young adults (aged 18 to 21, and exceptionally up to 25) in Spanish prisons. Using a multidisciplinary and documentary approach, it examines the supranational and historical foundations that inspired Spanish penitentiary regulations, the General Penitentiary Organic Law (LOGP) and its Regulations (RP 1996). The principle of age-based separation and the need for individualized treatment, reinforced with educational, employment, and psychosocial intervention programs, are highlighted. Based on statistical data and qualitative studies, the minority but vulnerable representation of this group in prison is evident, marked by factors such as social exclusion, educational failure, poverty, and family breakdown. The research, therefore, proposes strengthening the educational nature of the juvenile-adult prison system, focusing on re-education, reoffending prevention, and rehabilitation.
