AB La France fait indubitablement figure de bonne élève s¿agissant de ses engagements envers la Charte sociale européenne. Pourtant, sur le plan interne, le bilan était plus mitigé au regard du manque d¿effectivité de la Charte en raison du rejet de son caractère justiciable. Ces dernières années, le sort de la Charte s¿est amélioré du fait de la reconnaissance de son effet direct par les juges français. Néanmoins, cette reconnaissance n¿étant que partielle et certaines contrariétés du droit français à la Charte persistant, des progrès semblent encore possibles.
AB Por Francia, sin duda, ha sido una buena alumna en sus compromisos asumidos en virtud de la Carta Social Europea. Sin embargo, en el ámbito nacional, los antecedentes son más variados en cuanto a la falta de efectividad de la Carta debido al rechazo de su justiciabilidad. En los últimos años, la suerte de la Carta ha mejorado gracias al reconocimiento de su efecto directo por parte de los jueces franceses. Sin embargo, comoeste reconocimiento es sólo parcial y persisten algunas divergencias normativas con respecto a los estándares de la Carta, todavía hay margen de mejora.
AB France is undoubtedly a "model student" inits commitments to the European Social Charter. However, at the domestic level, the picture was more mixed with regard to the Charter's lack of effectiveness due to the rejection of its justiciable nature. In recent years, the fate of the Charter has improved due to the recognition of its direct effect by French judges.Nevertheless, as this recognition is only partial and some violations of the Charter by French law persist, there is still room for progress.
