AB La Ley Orgánica 1/2025 incorpora formalmente mecanismos de justicia restaurativa en las normas procesales españolas. La Ley, centrada en mejorar la eficiencia del servicio público de Justicia, introduce por primera vez en el ámbito penal una regulación específica para los procedimientos restaurativos, en lugar de regular la mediación penal. Se analizan las múltiples ventajas que presenta la justicia restaurativa como método para alcanzar los fines de las penas, orientados hacia la reeducación y reinserción social conforme al artículo 25.2 de la Constitución Española. La justicia restaurativa es una de las herramientas más eficaces al servicio del ideal resocializador. La regulación del mecanismo restaurativo se ha realizado de forma independiente al resto de medios alternativos de resolución de conflictos, por considerar el legislador que la justicia restaurativa va mucho más allá.
AB Organic Law 1/2025 formally incorporates restorative justice mechanisms into Spanish procedural regulations. This law, aimed at improving the efficiency of public justice services, introduces for the first time in the criminal sphere a specific legal framework for restorative procedures, rather than simply regulating penal mediation. The analysis highlights the multiple advantages of restorative justice as a method for achieving the purposes of punishment, particularly re-education and social reintegration in accordance with Article 25.2 of the Spanish Constitution. Restorative justice stands out as one of the most effective tools in support of the resocialisation ideal. The regulation of the restorative mechanism has been carried out independently from other alternative dispute resolution methods, based on the legislator’s view that restorative justice extends well beyond traditional mediation.
