AB El artículo analiza el tratamiento procesal en el proceso penal español de la enajenación mental sobrevenida cuando ya se ha dictado sentencia y se alega cuando se va a proceder a ejecutar dicha sentencia. Todo ello a partir de dos supuestos: preexistencia de enajenación metal o enajenación mental sobrevenida.
AB This article analyses the procedural treatment, within Spanish criminal proceedings, of supervening mental incapacity when a judgment has already been rendered and such incapacity is alleged at the stage of enforcement of the judgment. The analysis is based on two scenarios: the pre-existence of mental incapacity and the supervening onset of mental incapacity.
