Abstract
La protección jurídica ofrecida ante los delitos de sexting se encuentra en continua evolución, tratando de adaptarse a una realidad dinámica y cambiante, marcada por el desarrollo de las tecnologías, plantea el reto de adaptar e introducir nuevos escenarios legislativos capaces de hacer frente a este nuevo fenómeno introduciéndose, de este modo, el artículo 197.7 CP, donde se regula la acción del reenvío masivo de contenido explícito y reservado de las personas. Se propone que, entre otras medidas, ciertas conductas punibles introducidas tras la aplicación del mencionado artículo, abandonen su reproche de carácter penal, devolviendo su protección al ámbito civil, con fundamento en los principios de intervención mínima y ultima ratio. Se hace necesaria una adaptación legislativa sensible con la protección de todos los bienes jurídicos implicados en este hecho delictual.
The legal protection offered in the face of sexting offences is in continuous evolution, trying to adapt to a dynamic and changing reality, marked by the development of technologies, poses the challenge of adapting and introducing new legislative scenarios capable of dealing with this new phenomenon, thus introducing Article 197.7 CP, which regulates the action of mass forwarding of explicit and reserved content of persons. It is proposed that, among other measures, certain punishable conducts introduced after the application of the aforementioned article, abandon their criminal reproach, returning their protection to the civil sphere, based on the principles of minimum intervention and ultima ratio. It is necessary to adapt legislation in a way that is sensitive to the protection of all the legal assets involved in this criminal offence.
