Abstract
Este trabajo pretende dar criterios para determinar cuándo los tribunales tienen competencia para someter a su juicio decisiones gubernamentales sobre cómo combatir el cambio climático. Para ello se identifican los intereses presentes en la litigación climática y las obligaciones de los Estados bajo el Derecho Internacional (tanto con carácter general como especial en relación con el cambio climático), para luego analizar los límites de las competencias de los tribunales cuando se trata de evaluar si las medidas adoptadas por un gobierno para combatir el cambio climático son o no suficientes. Este trabajo termina con unas conclusiones de carácter práctico.
This article intends to provide criteria to determine when courts have powers to render under their judgement governmental decisions on how to fight against climate change. To this end, existing interests in climate litigation, as well as obligations of the States under International Law (both generally and especially in relation to climate change), are identified. The limits of the powers of courts when assessing whether the measures taken by a government to fight against climate change are or not sufficient, are then analyzed. This article ends with come practical conclusions.
