CONVERSACIONES ENTRE LA NORMA INTERNACIONAL Y LA NORMA INTERNA: LA APLICACIÓN POR LOS ÓRGANOS JUDICIALES

Abstract

Según el sistema monista, vigente en España, las normas internacionales de trabajo, una vez son publicadas oficialmente, pasan a constituir derecho interno y por ello son aplicables al mismo nivel que las normas emanadas del propio Estado. El debate radica, por una parte, en la jerarquía normativa en la que se inserta, y por otra, en la aplicación por parte de los tribunales de dichas normas. La función jurisdiccional implica el respeto de estas normas, basado en su conocimiento, y su aplicación teniendo en cuenta la doctrina jurisprudencial de las instancias internacionales que se encargan de su control y vigilancia. -----------------------------------------------------------------------------According to the monist system in force in Spain, the international labour standards, once officially published, become internal law and for that reason applicable at the same level as the rules emanated from the State. The debate is situated on one side, in the normative hierarchy in which it is placed, and on the other, in the application by the tribunals of such rules. The jurisdictional function implies; the respect of these rules, based on their knowledge, and their application taking into account the jurisprudential doctrine of the international bodies which are in charge of their control and oversight.
