Las garantías procesales de los derechos estatutarios: aspectos competenciales y jurisdiccionales

Abstract

La introducción en los Estatutos de Autonomía de un listado de derechos estatutarios plantea también el problema de su protección. Dentro de las diversas vertientes que dicho problema posee, en este trabajo se examinará hasta qué punto pueden las Comunidades Autónomas contribuir a dicha protección creando especialidades procesales, y de qué forma los Estatutos pueden ayudar a fundamentar dicha posibilidad. El análisis de la jurisprudencia constitucional relativa al art.149.1.6 CE, que ha interpretado este artículo de una manera sumamente restrictiva, y el examen de las nuevas previsiones estatutarias en este ámbito permiten concluir que las posibilidades que las Comunidades Autónomas tienen de contribuir a la regulación de la protección jurisdiccional de los derechos estatutarios son aún hoy muy limitadas, aunque en absoluto inexistentes.---------------------------------------------------------------------The introduction in the Statutes of Autonomy of a list of statutory rights creates the problem of their protection. Among the various aspects of this problem, this paper will examine the extent to which the Autonomous Communities can contribute to this protection by creating procedural specialties, and how the Statutes may contribute to support this possibility. The analysis of the constitutional jurisprudence relating to art. 149.1.6 SC, which has interpreted this article in an extremely restrictive way, and the review of the new statutory provisions in this area, lead to the conclusion that the chances that the Autonomous ommunities have to contribute to the regulation of the jurisdictional protection of statutory rights are still very limited, but not nonexistent.
