Abstract
Durante las primeras semanas del estado de alarma declarado por el Gobierno español para afrontar la crisis de la COVID-19, algunos alcaldes dictaron bandos en los que se establecían medidas restrictivas de los derechos fundamentales de sus vecinos. Estos bandos se enmarcan dentro de la categoría conocida como bandos de necesidad, que permite al alcalde adoptar en caso de catástrofe o infortunio público las medidas que se estimen necesarias y adecuadas. Teniendo en cuenta este contexto, en este trabajo se analiza la figura de los bandos del alcalde, prestando especial atención a su papel en situaciones de necesidad, y contribuyendo a la interpretación del escueto régimen jurídico que establece la LBRL. Se estudia también la potestad normativa del alcalde, tradicionalmente negada por la doctrina, y que hoy encuentra un claro refrendo normativo en las últimas reformas legislativas, estatales y autonómicas.
During the first weeks of the state of alarm declared by the Spanish Government to deal with the COVID-19 crisis, some mayors issued edicts establishing measures restricting fundamental rights. These edicts fall within the category known as “edicts in situation of need”, which allow the mayor to adopt, in the event of a catastrophe or public misfortune, the measures deemed necessary and appropriate. In this context, the article analyzes this kind of norms, paying attention to their role in situation of need and its regulation in the legal framework of the LBRL. Th article also studies the regulatory power of the mayor, traditionally denied by scholarship, and that today finds a clear regulatory endorsement in the latest legislative reforms, bot at the central and regional levels.
