Contrato social y género en el constitucionalismo republicano (1873-1883): Especial referencia al caso andaluz

Abstract

Se estudia el modelo de contrato social contenido en los proyectos de Constitución de Andalucía, enfatizando en la variable género. Se toma como punto de partida la crítica que Proudhon y Pi y Margall dedicaron a la teoría contractualista de Rousseau (1). Posteriormente se contrasta la presencia de los referentes intelectuales de ambas teorías en la estructura del proyecto andaluz (2). Asimismo, se rastrea la posición jurídica de la mujer y el principio de igualdad social en el movimiento republicano confederal y su ideología a fines del siglo XIX (3), para a continuación analizar su tratamiento por parte de la Constitución de Antequera (4).This article focuses on the social contract model that can be found in the different Andalusian Constitution projects, emphasising the gender variable. The starting point is the criticism that Proudhon and Pi y Margall make about Rousseau's theories (1). Afterwards, the article presents the contrast between the intellectual references of both theories in the Andalusian project structure (2). Additionally, there is an analysis of women legal status and equality principle within the confederal republican movement and its ideology at the end of XIX century (3), which is linked to the treatment that those status and principle received in the Antequera Constitution (4).
