Abstract
La irrupción de la terrible pandemia que la humanidad está padeciendo como consecuencia de la COVID 2019 ha tenido implicaciones económicas, sociales y jurídicas de todo orden. Entre ellas, no son las de menor calado las que afectan al espectro de las relaciones laborales.
En tan insoslayable contexto, el presente trabajo pretende analizar, de un lado, cómo la pandemia ha generado nuevas necesidades de cuidados que las personas trabajadoras se ven abocadas a abordar; o, al menos y en un gran número de casos, ha aumentado o recalibrado las ya existentes.
De otro, la respuesta jurídica que el legislador de urgencia ha tratado de dar a esta realidad incontestable, a través de una batería de medidas que, sin duda, han cambiado de forma significativa (¿y provisional?) el status quo laboral previo a la pandemia Las medidas de emergencia han pretendido facilitar la conciliación de la vida personal, familiar y laboral en un momento especialmente complicado, y aparecen preñadas de buenas intenciones, aun cuando también sea posible detectar algunas deficiencias y disfunciones que merecerán reflexión serena.
El trabajo se cierra con una conclusión sobre las implicaciones de fondo que la renovada necesidad de conciliación de la vida laboral, personal y familiar tiene desde el punto de vista jurídico y social, intentando efectuar una previsión sobre su evolución futura una vez superada la pandemia.
The COVID 2019 has had economic, social and legal implications of all kinds. Among them, the less important ones are not those that affect the spectrum of labor relations.The present work triesto analyze, on the one hand, how the pandemic has generated new care needs or, at least and in a large number of cases, has increased or recalibrated existing ones.On the otherhand, the legal response that the emergency legislator has tried to give to this incontestable reality, through a battery of measures that, without a doubt, have significantly changed the labor status quo prior to the pandemic and that, in some cases, they involve changes that are likely to find consolidation once the emergency situation has been overcome.The work is closedwith a reflection on the substantive implications that the renewed need to reconcile work, personal and family life has from the legal andsocial point of view, trying to make a forecast on its future evolution.
