La protección frente al despido arbitrario: el criterio del Comité Europeo de Derechos Sociales y la respuesta del Tribunal Supremo

Abstract

El presente estudio analiza la tutela frente al despido sin causa justa, especialmente a partir de su abaratamiento con la reforma laboral de 2012, bajo la premisa de que el Derecho del Trabajo debe garantizar la protección de las personas trabajadoras ante la pérdida de su medio de subsistencia. Se cuestiona si la indemnización tasada y topada prevista para el despido improcedente cumple efectivamente una función resarcitoria y disuasoria adecuada o si, por el contrario, resulta insuficiente para reparar íntegramente el daño producido. La regulación del despido arbitrario ha experimentado una intensa evolución normativa, doctrinal y jurisprudencial. Tras la ratificación por España de la CSER, el CEDS ha considerado que nuestro ordenamiento jurídico vulnera su artículo 24 al no permitir una reparación íntegra, ni proteger suficientemente a las personas trabajadoras frente a despidos injustificados. Esta interpretación contrasta con la jurisprudencia del Tribunal Supremo, que niega eficacia directa a dichas decisiones y sostiene la validez del actual modelo indemnizatorio. El objetivo es ofrecer una visión integral sobre la eficacia y alcance de las normas de protección frente al despido injustificado.

This paper analyses protection against dismissal without fair cause, particularly following its reduction in cost under the 2012 labour reform, on the premise that Labour Law must guarantee the safeguarding of workers against the loss of their means of subsistence. It questions whether the fixed and capped compensation provided for unfair dismissal effectively fulfils an adequate compensatory and deterrent function or whether, on the contrary, it proves insufficient to fully redress the harm caused. The regulation of arbitrary dismissal has undergone intense legislative, doctrinal and jurisprudential development. Following Spain’s ratification of the Revised European Social Charter, the European Committee of Social Rights has considered that our legal systeminfringes Article 24 by failing to allow full reparation and by not sufficiently protecting workers against unjustified dismissals. This interpretation contrasts with the case law of the Supreme Court, which denies direct effect to such decisions and upholds the validity of the current compensation model. The aim is to provide a comprehensive view of the effectiveness and scope of the rules on protection against unjustified dismissal.
