El discurso de odio online y su persecución por el Tribunal Europeo de Derechos Humanos

Abstract

La incitación al odio online puede producirse y distribuirse fácilmente sin esfuerzo e incluso de forma anónima, con posibilidad de llegar a una audiencia global y diversa en tiempo real. Por no hablar de que los contenidos online permanecen en la red y pueden resurgir y ganar popularidad con el paso del tiempo. Ello ha provocado que algunos Estados responsabilicen a las empresas que gestionan el flujo de informaciones y opiniones desde Internet, lo que suscita preocupación por la limitación de la libertad de expresión frente a la protección de los derechos de terceros. Por ello, la comprensión y el análisis que esté haciendo sobre esta cuestión el Tribunal Europeo de Derechos Humanos (en adelante el TEDH) es fundamental para dar forma a una respuesta efectiva, armonizada y viable para todos los Estados Miembros del Consejo de Europa.

Online hate speech can easily be produced and distributed effortlessly and even anonymously, with the potential to reach a global and diverse audience in real time. Not to mention that online content remains online and can resurface and gain popularity over time. This has led some states to hold companies responsible for managing the flow of information and opinions from the internet, raising concerns about limiting freedom of expression versus protecting the rights of others. Therefore, the ongoing understanding and analysis of this issue by the European Court of Human Rights (hereinafter the ECtHR) is crucial in shaping an effective, harmonised and workable response for all Council of Europe Member States.
