Abstract
En los últimos años se han incrementado las enfermedades relacionadas con las patologías encuadradas dentro del síndrome del espectro de desregulación, o enfermedades de sensibilización central, no conociéndose las causas de estos padecimientos.
Este artículo analiza el tratamiento jurídico de estas patologías a efectos de su reconocimiento como situación incapacitante permanente en la seguridad social. Para ello es necesario adentrarse en el conocimiento nosológico de estas enfermedades, analizando las peculiaridades de aquellas que generan un mayor impacto a nivel incapacitante, centrando este análisis en tres enfermedades encuadradas en este síndrome, fibromialgia, síndrome de fatiga crónica y síndrome de hipersensibilidad electromagnética, por ser las enfermedades que presentan un mayor número de personas afectadas y un mayor impacto en el ámbito laboral. Se incidirá en las características fundamentales de este tipo de enfermedades que, en los casos en los que la afectación patológica refiera una especial gravedad, podrán ser susceptibles de reconocimiento incapacitante permanente, a través del tratamiento con el que se abordan estas situaciones en el ámbito administrativo de gestión de la seguridad social y posteriormente por parte de jueces y tribunales.
In recent years, diseases related to pathologies that fall within the dysregulation spectrum syndrome, or central sensitization diseases, have increased, with the causes of these conditions not being known. This article analyzes the legal treatment of these diseases for the purposes of their recognition as a permanent disabling situation in social security. To do this, it is necessary to delve into the nosological knowledge of these diseases, analyzing the peculiarities of those that generate a greater impact at a disabling level and the jurisprudential treatment that is carried out on them for the purposes of disabling recognition, focusing this analysis on three diseases framed in this syndrome, fibromyalgia, chronic fatigue syndrome and electromagnetic hypersensitivity syndrome, as they are the diseases that present a greater number of people affected and a greater impact on the workplace. The present work aims to establish a reference to the fundamental characteristics of diseases that, arising from a serious situation, require recognition of permanent work incapacity, and to delimit the legal treatment given to these situations in the administrative field of social security management and later by judges and courts
