Tutela judicial efectiva y ejecución por sustitución en procesos civiles

Abstract

El artículo 18 de la Ley Orgánica del Poder Judicial impone la ejecución de las sentencias en sus propios términos, aunque permite la sustitución de la condena contenida en el fallo por un equivalente pecunario. Estudiamos el alcance de dicha previsión legal en relación al derecho a la tutela judicial efectiva de ambas partes del proceso ejecutivo; para concluir analizando la tipología de causas que pueden motivar tal sustitución, y la tramitación a seguir dependiendo de la naturaleza obligacional de la prestación impuesta al ejecutadoArticle 18 of the Organic Law of the Judiciary mandates that judgments be enforced according to their own terms. This study examines the exception provided in that provision, which allows the substitution of the obligation imposed by a judgment with a pecuniary equivalent. It analyses the various grounds that may give rise to this procedural situation and the steps to be followed depending on the legal nature of the obligation imposed on the judgment debtor.
