Abstract
El contrato de formación en alternancia forma parte de la profunda reforma llevada a cabo en el año 2021 en el mapa contractual laboral español. Con el objetivo principal de mejorar a su antecesor en términos de temporalidad y precariedad, esta modalidad del contrato formativo mantiene su objeto dual consistente en dotar de práctica profesional y formación a aquellos trabajadores menos cualificados. El presente trabajo pretende analizar la evolución del requisito formativo y las principales dificultades que afronta en su principal objetivo de empleabilidad y estabilidad de los trabajadores a través del análisis legal y práctico de la cualificación pretendida por el legislador y las vicisitudes que sufre y que dificultan el éxito de un tipo de contrato a priori ventajoso para el empresario, pero que observa no pocas trabas en su doble objetivo formador.
The alternating training contract is part of the profound reform carried out in 2021 in the Spanish labor contract map. With the main objective of improving its predecessor in terms of temporality and precariousness, this type of training contract maintains its dual purpose of providing professional practice and training to less qualified workers. This paper aims to analyze the evolution of the training requirement and the main difficulties it faces in its main objective of employability and stability of workers through the legal and practical analysis of the qualification intended by the legislator and the vicissitudes it suffers and that hinder the success of a type of contract a priori advantageous for the employer, but that observes no few obstacles in its dual training objective.
