Abstract
En este trabajo se defenderá la necesidad de apostar por alternativas alojacionales donde las condenadas madres puedan cumplir la pena de prisión impuesta junto a sus hijos e hijas menores de tres años, pero también, y sobre todo, la conveniencia de prever alternativas al propio cumplimiento de la misma y, más concretamente, porque se permita el diferimiento de la ejecución de la condena hasta que los niños o niñas a atender cumplan la dicha edad, con posibilidad de sustituirlo por una detención domiciliaria si ello se estimase necesario para no frustrar las exigencias de seguridad. Ambas posibilidades están previstas en el Ordenamiento Jurídico italiano y serán analizadas en este artículo, para saber en qué consisten, cuáles son los requisitos para su concesión y quién es la autoridad competente para ello, pero también con el deseo de que sirvan de inspiración al legislador español a la hora de emprender el necesario camino hacia la descarcelación de las condenadas madres y, en consecuencia, a favor de una ejecución penal sensible a los intereses de los y las menores.
In this paper we will defend the necessity of betting on housing alternatives where convicted mothers can serve the prison sentence imposed together with their children under three years of age, but also, and above all, the convenience of providing alternatives to serving the sentence itself and, more specifically, to allow the deferral of the execution of the sentence until the children to be served reach that age, with the possibility of replacing it with home detention if deemed necessary in order not to frustrate the requirements of security. Both possibilities are provided for in the Italian legal system and will be analysed in this article, in order to know what they consist of, what are the requirements for granting them and who is the competent authority for this purpose, but also with the hope that they will serve as inspiration for the Spanish legislator when it comes to taking the necessary path towards the decarcelation of convicted mothers and, consequently, in favour of a penal execution sensitive to the interests of the minors.
