¿Qué perspectivas para el constitucionalismo social en Europa? (buscando, e intentando encender, luces en tiempos oscuros)

Abstract

En este ensayo se propone, en primer lugar, un análisis crítico de la evolución de la relación entre el proceso de integración europea y los principios del constitucionalismo social (solidaridad, igualdad sustancial, reconocimiento y protección de los derechos sociales), destacando las implicaciones de los recientes cambios constitucionales que han afectado a la Unión Europea y a los Estados miembros en el contexto de la crisis económica, produciendo el «desplazamiento de la Europa social¿. En segundo lugar, se afirma la necesidad de llegar a una reconciliación entre dicho proceso y tales principios y, en esta perspectiva, se consideran los límites de las recientes iniciativas de las instituciones europeas (en particular, el llamado «pilar europeo de derechos sociales¿) y se identifican estrategias y soluciones ulteriores (incluyendo el desarrollo de sinergias con el sistema de la Carta Social Europea), que deberían aplicarse para alcanzar ese objetivo y recuperar la solidaridad como principio fundamental del Derecho Constitucional europeoThis essay firstly proposes a critical analysis of the evolution of the relationship between the European integration process and the principles of Social Constitutionalism (solidarity, substantive equality, protection of social rights), paying special attention to the constitutional changes that have affected the European Union and the Member States in the context of the recent economic crisis and have concretely entailed the «displacement of Social Europe». Secondly, it is argued that reconciling that process with the mentioned principles is necessary: in this perspective, the paper highlights the limits of some recent initiatives of the European institutions (namely, the European Pillar of Social Rights) and points out some further strategies and solutions (including the development of synergies with the system of the European Social Charter) which should be applied in order to achieve that objective and to restore solidarity as a fundamental principle of European Constitutional Law
