El incidente de evaluación de la falta de capacidad del sujeto pasivo en el proceso penal

Abstract

Este trabajo analiza cómo debe actuarse en un proceso penal cuando se detecta la posible incapacidad del investigado, imputado o acusado. En qué momento procesal hay que proceder a la evaluación de la discapacidad, competencia judicial para resolver ese incidente, cómo se llega a la conclusión sobre la existencia o no de discapacidad en el investigado, alcance de dicha discapacidad en relación a su defensa en el proceso penal y, en su caso, medidas que garanticen su derecho constitucional de defensa a lo largo del proceso.

This paper examines how criminal proceedings should be conducted when the possible lack of capacity of the person under investigation, the indicted person, or the accused is identified. It analyses the procedural stage at which the assessment of disability must be carried out, the judicial authority competent to decide such incidental proceedings, the criteria for determining the existence or absence of disability in the person concerned, the scope of such disability in relation to the exercise of the right of defence in criminal proceedings, and, where appropriate, the measures required to guarantee the constitutional right to defence throughout the proceedings
