Abstract
En este trabajo se analiza el impacto de la reforma de la legislación laboral en materia de negociación colectiva introducida por el Real Decreto-Ley 32/2021, de 30 de diciembre.
En el trabajo se estudian las medidas introducidas especialmente en tres direcciones: la recuperación del papel esencial del convenio de sector en la determinación del salario, la recuperación del régimen de prórroga indefinida del contenido del convenio en defecto de que otra cosa se pacte, y la determinación del convenio aplicable en los casos de contratas entre empresas. Se hace una mención también de aspectos clave del sistema de negociación colectiva que no se han modificado y se analizan las intenciones de la reforma, valorando su orientación hacia la recuperación de derechos que se vieron afectados por anteriores reformas legales, especialmente la del año 2012.
This study analyses the impact in collective bargaining of labour laws reform established by the Royal Decree Law32/2021, of 30th December. This paper examines the introduced measures in three directions: the prevalence of sectoral collective bargaining agreements in setting wages, recovering the indefinite extension of collective agreements unless otherwise stated, and rules for determining the collective agreement applicablein business-to-business contracts. This study additionally mentions key elements on collective bargaining system that have not been modified and also focus on this reform intentions, specially their orientations towards the workers rights recovery that were affected by previous labour laws reforms as the reform performed in 2012.
