Derecho Familiar del Trabajo y de la Seguridad Social

Abstract

Las mujeres se han incorporado al mundo laboral en situación de desventaja, cargando el rol de género que la sociedad les ha impuesto (principales responsables de los hijos y de la administración del hogar). El único reconocimiento que el Derecho Laboral les ha concedido son los derechos de las madres, los cuales si bien constituyen un avance, han dejado de evolucionar y no han podido transformarse en lo que debería ser: el ¿Derecho Familiar del Trabajo y de la Seguridad Social¿ y no sólo obligaciones y prestaciones para mujeres trabajadoras. Es por ello que este artículo incorpora un análisis jurídico de las prestaciones laborales vigentes para las madres trabajadoras en la iniciativa privada y su relación con el Derecho Familiar en México.----------------------------------------------------------------------------Women have entered the workforce in disadvantage, carrying with them a gender role imposed by society (they are responsible of taking care of the children and organizing the house administration). The only recognition that the Labor Law has granted to these women are the called ¿motherhood rights¿; although they constitute an important improvement in the Law sector, they stopped evolving and did not become in what they really should be: ¿Family Labor and Social Security Law" and not only obligations and benefits for working women. Therefore, this article incorporates a legal analysis about the labor benefits for working mothers in the private initiative and its relationship with the Family Law in Mexico.
