Abstract
En février 2015, EUROCEF (comité européen d¿action spécialisée pour l¿enfant et la famille dans leur milieu de vie) déposait, auprès du Comité européen des droits sociaux, une réclamation collective contre la France pour non-respect de ses engagements au regard de la Charte sociale européenne, pour ce qui concerne l¿accueil et l¿accompagnement des mineurs étrangers non accompagnés (MENA) arrivant sur son territoire.
La décision du Comité européen des droits sociaux considérant qu¿il y avait plusieurs cas de violation des dispositions de la Charte sociale européenne, et la résolution du Comité des Ministres qui s¿en est suivie, doit amener la France à revoir son dispositif d¿ accueil et d¿accompagnement des MENA, tant du point de vue de sa réglementation que des pratiques en usage.
Cette prise de position des instances européennes constitue bien sûr une mise en cause de la France, mais surtout rappelle à l¿ensemble des européens que la Charte sociale européenne est un des instruments les plus importants pour la défense et la promotion des droits sociaux des minorités.
In February 2015 , European Committee for Home-Based Priority Action for the Child and the Family (EUROCEF) submitted to the European Committee of Social Rights a collective complaint against France for non-compliance with its commitments under of the European Social Charter, as regards the reception and accompaniment of unaccompanied foreign minors arriving in French territory.The decision of the European Committee of Social Rights considering violation of several provisions of the European Social Charter, and the subsequent Resolution of the Committee of Ministers, should lead France to reconsider its reception and accompaniment of Unaccompanied Foreign Minors, both from the point of view of their regulation and the practices in use.This position of the European authorities is of course a challenge to France, but especially reminds all Europeans that the European Social Charter is one of the most important instruments for the defense and promotion of social rights of minorities.
