Abstract
La nueva redacción recibida por el artículo 510.1 tras la reforma introducida en el Cp español por la LO 1/2015, de 30 de marzo, le otorga un contenido con el que se reabre la vieja polémica de la legitimidad del Derecho penal para limitar el ejercicio del derecho a la libertad de expresión. En la Exposición de Motivos de dicha ley nuestro legislador fundamenta el nuevo tenor de este precepto en la necesidad de ajustar nuestra regulación penal a las exigencias de la Decisión Marco 2008/913/JAI del Consejo, de 28 de noviembre de 2008, que, considera, no había sido traspuesta de forma adecuada. El objeto de este trabajo es analizar si efectivamente el nuevo tenor literal del artículo 510.1 a) Cp ha de dar lugar al cambio de la línea interpretativa que en dicha sentencia se refleja.
The new wording received by article 510.1 after the reform introduced in the Spanish Code by LO 1/2015, of March 30, gives it a content with which the old controversy of the legitimacy of criminal law is reopened to limit the exercise of the right to freedom of expression. In the Explanation of Reasons of said law, our legislator bases the new tenor of this precept on the need to adjust our criminal regulation to the requirements of Framework Decision 2008/913/JAI of the Council, of November 28, 2008, which, considers , had not been transposed properly. The purpose of this work is to analyze whether indeed the new literal wording of article 510.1 a) Cp must give rise to the change of the interpretative line that is reflected in said sentence.
