Abstract
Se analiza en este artículo la influencia del llamado Derecho penal del enemigo y la tesis
de la tolerancia cero en la doctrina y la legislación, dando lugar al surgimiento de un Derecho penal
de excepción que claramente se opone al modelo de Estado democrático. El autor analiza críticamente
las propuestas de estos planteamientos de política criminal y como los mismos han sido considerados
en las reformas legales españolas.
Discussed in this article the influence of so-called enemy criminal law and the theory of zero tolerance doctrine and legislation, giving rise to a criminal law of exception that is clearly opposed to model democratic state. The author critically examines the proposals of these approaches to criminal justice policy and how these have been considered in the Spanish legal reforms.
