Abstract
En este artículo revisamos la conversión de la paz en una categoría de derechos humanos durante las últimas décadas desde tres perspectivas: 1) el proceso dual de codificación en el que destacaron la participación de organizaciones de la sociedad civil y las iniciativas de actores no estatales, 2) el estatuto del derecho a la paz dentro de los derechos humanos de tercera generación y en relación con la concepción de la paz positiva y 3) las implicaciones políticas derivadas de exigir la responsabilidad de los Estados y la promoción de la justicia social a nivel global. Concluimos que el resultado de esa juridificación hasta la fecha, la Declaración sobre el Derecho a la Paz, es probablemente un logro provisional en un proceso de aprendizaje colectivo de mayor alcance.
In this article we review the conversion of peace into a human rights category over the last decades considering three perspectives: 1) the two-track codification process in which the participation of civil society organisations and non-state actors’ initiatives were prominent, 2) the status of the right to peace within third-generation human rights and in relation to the conception of positive peace, and 3) some political implications derived from demanding the accountability of states and the promotion of social justice at the global level. We conclude that the ultimate outcome of this juridification process to date, the Declaration on the Right to Peace, is probably an interim achievement in a larger collective learning process.
