SISTEMA MEXICANO NO JURISDICCIONAL DE PROTECCIÓN DE LOS DERECHOS SOCIALES: COMISIÓN NACIONAL DE DERECHOS HUMANOS

Abstract

En México, la protección no jurisdiccional de los derechos humanos se encuentra enmarcada en las atribuciones constitucionales de la Comisión Nacional de Derechos Humanos. Su progreso normativo constitucional se evidencia a través del sentido de las recomendaciones, específicamente las relacionadas con los derechos sociales, emitidas a partir del año 2009, así como, con la interposición de acciones de inconstitucionalidad, promovidas ante la Suprema Corte de Justicia de la Nación, de leyes que van en contra de lo estipulado por la Constitución Política de los Estados Unidos Mexicanos.La naturaleza jurídica, antecedentes históricos, estructura y atribuciones de la Comisión, así como, el análisis del concepto de los derechos sociales, son temas que se abordan con el fin de que se vinculen con el contenido de las recomendaciones emitidas por la Comisión y las acciones de inconstitucionalidad referidas.---------------------------------------------------------------------------In Mexico, non-judicial protection of human rights is framed in constitutional mandate of the National Commission on Human Rights. Its normative constitutional progress is evidenced by the sense of the recommendations, particularly those related to social, issued since 2009 and, with the interposition of unconstitutionality promoted to the Supreme Court of Justice of laws that go against the provisions of the Constitution of the United Mexican States.The legal nature, historical background, structure and attributions of the Commission, as well as analysis of the concept of social rights, are issues that are addressed so that they relate to the content of the recommendations issued by the Commission and the actions referred unconstitutional.
