Retos pendientes en la protección del embarazo y de los derechos de conciliación de la vida familiar y laboral frente al despido

Abstract

La legislación española cuenta con instituciones, instrumentos y técnicas jurídicas para la protección de la situación de embarazo y de los derechos de conciliación de la vida familiar y laboral que la sitúan entre los Estados más avanzados de nuestro entorno. Las sucesivas reformas legislativas que arrancaron con la Ley 39/1999 y han concluido con el Real Decreto-Ley 6/2019, han reforzado la protección de estos derechos, añadiendo a la tradicional tutela discriminatoria una segunda tutela objetiva y automática que ha mejorado de forma notable las previsiones de las Directivas comunitarias. Sin embargo, la frontera entre ambos tipos de tutela, su configuración jurídica y alcance, así como la correcta identificación de las situaciones protegidas, no resulta del todo clara. Por otro lado, en el caso de mujer embarazada, que haya dado a luz o en período de lactancia natural nuestro ordenamiento jurídico podría no haber transpuesto correctamente el art. 10.1 de la Directiva 92/85. La revisión de las sentencias recaídas en las distintas instancias judiciales nos permitirá conocer los problemas que en la práctica está planteando la aplicación del segundo párrafo de los arts. 55.5 y 53.4 ET e identificar los retos que quedan pendientes en esta materia.

Spanish legislation has legal institutions, instruments and techniques for the protection of the situation of pregnancy and the rights to reconcile family and work life that place it among the most advanced States in our environment. The successive legislative reforms that began with Law 39/1999 and have concluded with Royal Decree-Law 6/2019, have reinforced the protection of these rights, adding a second objectiveand automaticprotection to the traditional discriminatory protection that has improved the provisions of the Community Directives. However, the border between bothtypes of guardianship, its legal configuration and scope, as well as the correct identification of protected situations, is not entirelyclear. On the other rand, in the case of a pregnant woman, who has given birth or is breastfeeding, tourlegal system may not have correctly transposed art. 10.1 of Directive 92/85. he examination of the sentences handed down in the different judicial instances, will allow us to know the problems that the application of the second paragraph of the arts. 55.5 and 53.4 ET and identify the challenges that remain pending in this matter.
