La demanda por el matrimonio civil igualitario: cuerpo y sexualidad en los discursos y prácticas de los operadores de justicia

Abstract

A partir del proceso constitucional promovido en el año 2018 por Cristina Mabel –una mujer trans– en contra del Registro Civil del Azuay-Ecuador, por haberse negado esta institución a registrar su matrimonio, propongo identificar las categorías a través de las cuales diversos operadores de justicia clasifican, visualizan y valoran los cuerpos de las personas trans que participan en un proceso judicial. Busco indagar cómo las personas trans se presentan ante la justicia y cómo reaccionan ante el trato que reciben. Pretendo, asimismo, descifrar las rutas, rutinas y rituales de los procedimientos judiciales en los que se ven inmersas personas trans y analizar cuáles son las consecuencias que produce en ellas estos procesos. El trabajo plantea que el derecho, inscrito en contextos históricos y específicas relaciones de poder, pretende moldear subjetividades, al imponer concepciones sobre lo normal y lo patológico, lo lícito y lo ilícito, lo permitido y lo prohibido. Al mismo tiempo, muestra que el derecho puede llegar a ser moldeado por quienes, como nuestra protagonista, cuestionan la rígida concepción de una sexualidad anclada a la naturaleza. Sus demandas representan un acto de libertad.

Based on the constitutional process promoted in 2018 by Cristina Mabel – a trans woman – against the Civil Registry of Azuay-Ecuador, for having refused this institution to register her marriage, I propose to identify the categories through which various justice operators classify, visualize and value the bodies of trans people who participate in a judicial process. I seek to investigate how trans people present themselves in justice and how they react to the treatment they receive. I also intend to decipher the routes, routines and rituals of the judicial procedures in which trans people are immersed and analyze what are the consequences that these processes produce in them. The work argues that law, inscribed in historical contexts and specific power relations, aims to shape subjectivities, by imposing conceptions about the normal and the pathological, the licit and the illicit, the allowed and the prohibited. At the same time, it shows that law can be shaped by those who, like our protagonist, question the rigid conception of a sexuality anchored to nature. Their demands represent an act of freedom.
