Abstract
La adopción de la Resolución sobre el crimen de agresión en la Conferencia de Kampala no hasupuesto el ejercicio inmediato de jurisdicción por la Corte sobre dicho crimen, al contrario, dicha Resolución establece un plazo de siete años para que se active la jurisdicción, así como un régimen que dificulta en gran medida el ejercicio de la misma. De este modo la Resolución opta por el artículo 121.5 del Estatuto para establecer el régimen de entrada en vigor y ejercicio de la jurisdicción, lo que ha dado lugar a diversas interpretaciones acerca de la competencia de la Corte sobre los nacionales de Estados que no han aceptado la jurisdicción o sobre crímenes cometidos en territorios de dichos Estados. Será por tanto necesario analizar el trabajo previo a la adopción de la Resolución así como las posiciones de los Estados durante la Conferencia, para determinar la interpretación más adecuada de las disposiciones de la misma.
The adoption of the Resolution about the crime of aggression at Kampala Conference does not entail the immediate Court's exercise of jurisdiction over the crime; on the contrary, the Resolution establishes a seven years delay and a complicate regime that make difficult the exercise of jurisdiction. The Resolution opts for article 121.5 of the Statute to establish the entry into force and exercise of jurisdiction mechanisms which has generated different interpretations on the Court's competence over nationals of States that has not accepted the amendment and over the crimes committed in such States. It will be necessary to analyze the previous work and the States¿ positions during the Conference to find out an accurate interpretation of the provisions.
