La relación laboral especial de artistas tras el Real Decreto Ley 5/2022

Abstract

El Real Decreto-ley 5/2022 introduce modificaciones en el RD 1435/1985, que regula la relación laboral de artistas. Estos cambios afectan tanto al ámbito de aplicación -al incluir al personal técnico y auxiliar, y dar una nueva redacción a los elementos de calificación de la relación-, como a la mejora de las condiciones laborales de las personas que desarrollan su actividad en este sector, afectando al régimen de contratación -introduciendo medidas para reforzar la estabilidad en el empleo- y a las indemnizaciones por extinción del contrato; y, finalmente, adapta la normativa de Seguridad Social de este colectivo a los cambios introducidos. En el presente trabajo se da cuenta de estas modificaciones, al tiempo que se ponen de relieve ciertas consideraciones críticas sobre las mismas.

Royal Decree-law 5/2022 has introduced various amendments to Royal Decree1435/1985, which regulates the employment relationship with artists. These changes affect mainly the scope of application (by including technical and auxiliary staff and rewording the qualifying elements of the relationship) and the improvement of the working conditions of the people who work in this sector, affecting the contracting regime (introducing measures to reinforce employment stability) and compensation for termination of the contract. Finally, the legal reformation adapts the Social Security regulations for this group to the changes introduced.This paper reports on these legal changes, while highlighting somecritical considerations about them
